INSTRUCTIONS FOR REQUESTING CERTIFICATION
Once a Notice of Decision for a Consent request is issued, a 20 day appeal period commences the day after the Notice of Decision was mailed (and emailed). PLEASE READ THE TRANSMITTAL LETTER sent with the Notice of Decision carefully. It has information that you need to know.
If the Decision of Consent under Section 53 of the Planning Act, or a condition of provisional approval is not appealed, the Decision becomes final and binding.
It is SOLELY the responsibility of the landowner(s)/applicant(s) to comply with any conditions of approval. DOCUMENTATION PROVING COMPLIANCE WITH THE RESPECTIVE CONDITION IS MANDATORY.
To complete the Consent for severance process, Certification is required. This will allow for conveyance (or transfer) of the subject new lot (or easement) to “perfect” the Consent.
[Note that a survey of land and registration of a Reference Plan identifying a parcel(s) of land or lands involved a Consent approval, DOES NOT create the parcel or the permanent easement.]
THE CERTIFICATION PROCESS
- The landowner(s)/applicant(s) must provide the solicitor they hire to process the Certificate of Consent, with a copy of the Notice of Decision, and all documentation proving compliance with each condition(s) of approval set out in Section 3 of the Notice of Decision.
DO NOT REMIT THE DOCUMENTATION PROVING COMPLIANCE WITH THE CONDITIONS directly to the NAPBoard. The documentation must come to the NAPBoard in a package with the Certification Form (prescribed by O Reg) and any other documentation prepared by your solicitor, along with the Certification Fee set out in the Notice of Decision.
- The solicitor’s staff may contact the NAPBoard for document template(s) of the Consent Agreement between the applicant(s) and the NAPBoard.
- Certification Requests must be remitted to the NAPBoard 30 days prior to the date on which the provisional approval will lapse OR the date the conveyance transaction is proposed to close, provided the closing date occurs prior the provisional approval lapsing.
